California Jury Orders $2 Billion Verdict Against Monsanto’s Roundup Product

About the Decision
A jury in Alameda County has ordered Monsanto—which was acquired last year by Bayer A.G.—to pay damages to a 76-year-old man and his 74-year-old wife after both were diagnosed with Non-Hodgkin’s Lymphoma after using Monsanto’s Roundup weed killer product on their property for decades. The jury found Roundup caused the couple’s cancer.
One of the couple’s attorneys argued that a billion-dollar judgment for each plaintiff would send Monsanto a message and based punitive damages on Roundup’s $892-million profit recorded in 2017. Another attorney for the couple said homeowners were at greater risk than landscaping professionals, since they were never advised to wear protective gear when using the product.
Glyphosate—the active ingredient in Roundup—is the most widely used weed killer in the world. While Monsanto’s parent company, Bayer A.G., has repeatedly claimed the chemical is safe, the World Health Organization (WHO) has declared glyphosate to be a “probable human carcinogen.” In contrast, the United States Environmental Protection Agency (EPA) recently stated “there are no risks to public health when glyphosate is used in accordance with its current label.”
A History of Legal Action
In August 2018, a state court in San Francisco awarded $289 million to a school groundskeeper after they found Roundup had caused his cancer. Two months ago, a federal jury in the same city awarded $80 million to a man who claimed Roundup caused his Non-Hodgkin’s Lymphoma. Currently, there are thousands of other lawsuits against Monsanto pending in both federal and state courts.
